When you first contact us

When you contact us for the first time, we will connect you with a member of our team with the appropriate legal and technical expertise to match your needs for an initial conversation to obtain an overview of your requirements. This will be prior to any formal engagement to provide specific advice and/or assist in creating IP rights.

Before we start working with you 

Before we start working together, we will undertake a “conflict check” to establish whether our new relationship with you would create an actual or possible conflict of interest, or in other words, whether the nature of the work we would be doing with you could or would compromise the interests of an existing client.

In the event of a clear conflict check, we will provide our local clients with our Terms of Engagement, which set out the terms applying to our ongoing working relationship, including information about joint expectations, our professional fees, billing arrangements and communications.

In line with our professional requirements, we will also provide you with a scope of work and a cost estimate for performing that work and will identify the members of our team who will be primarily responsible for conducting that work.

Code of conduct 

Our conduct is governed by the Code of Conduct for Patent and Trade Marks Attorneys administered by the Trans-Tasman IP Attorneys Board, a Commonwealth statutory authority which administers the Patent and Trade Marks profession (www.ttipattorney.gov.au).

Madderns and its professional staff are also members of the Institute of Patent and Trade Mark Attorneys Australia (IPTA) which is the peak professional body representing Australian Patent and Trade Marks Attorneys (www.ipta.com.au). As members of IPTA, our professional staff are obliged to follow the IPTA Code of Ethics, which is available on request.
